Proposed Class Action Lawsuit

As communicated in February 2021, a proposed class action was commenced against St. Thomas More Collegiate, Vancouver College Ltd., The Roman Catholic Archbishop of Vancouver, The Roman Catholic Episcopal Corporation of St. John’s and The Catholic Independent Schools of the Vancouver Archdiocese.

The action alleges abuse (physical and/or sexual) by former Christian Brothers faculty in the period 1976 to 2013 at Vancouver College and St. Thomas More Collegiate. (see Feb. 8 2021 School Communications)

Important Updates

The current phase of this action is procedural only and addresses the plaintiff’s application to the court to certify the action under the Class Proceedings Act.

January 31, 2022: Vancouver College and the other defendants filed its initial responses to the underlying civil action and to the plaintiff’s application for certification of the case as a class action.

Summary of Vancouver College’s position on certification request that the court certify the case as a class action: Vancouver College is committed to ensuring that appropriate legal processes are used to address any allegations of abuse claims. Since allegations of abuse claims raise very sensitive and individual issues, Vancouver College is opposed to certification. The procedural framework used for class actions is not the preferable process to address the claims being made. Vancouver College seeks to respond to the claims in an individualized and more efficient manner.

August 2022: The hearing of the plaintiff’s certification application (and other related matters) is scheduled to be heard by the courts.
